She took the posting down, but the principal suspended her for "bullying and cyber bullying harassment towards a staff member." She graduated and is now suing to have the suspension removed from her record.

If the kid was saying the same nasty things about a classmate, there would be no disagreement about the suspension. Just because she is targeting a teacher, doesn't make this kid any less Foul. 	wait - why is that spot on? the lawsuit was filed by the ACLU for an alleged violation of her first amendment rights. also, i'm not sure the suspension would have been warranted if her comments were against another student. i think the lawsuit is fair but the girl is a jerk and she should just move on with her life. 	i don't think fair or fouls are meant to be so literal and dissected. there are elements of fair and elements of foul, one has to win out, so you just vote. it's foul because while technically, yes, maybe she has a case, but this is just such a stupid waste of time. i didn't think the aclu was funding this, i thought they got involved after the suit. in any event, the actions on both sides are just so minor and then suddenly a lawsuit. it's like using a sledgehammer to kill a fly. foul.
